Governor Jan Brewer clearly has not read the Supreme Court opinion on SB 1070. She and Tea-Publicans in the Arizona legislature are running a propaganda offensive claiming "victory," when in fact SB 1070 is in serious trouble. The corporate "lamestream" media keeps saying that the "papers please" provision was "upheld." This is imprecise. The Court simply said it is not preempted by federal law at this preliminary stage.
The Court remanded the case back to the trial court for a trial on the merits. Arizona Courts may find the "papers please" provision is unconstitutional or violates federal law because it hinders the federal immigation law scheme outlined by the Court in this opinion. In short, the Court left this question to be resolved another day on an evidentiary trial record. The opinion today did not "uphold" the provision as constitutional. That issue remains to be decided.
I predict the trial court will issue an injunction when the case returns to the trial court, to remain in effect until the conclusion of the trial (and later on appeal).
